It is hereby clarified that these terms and conditions exclusively govern sales by Francine Joaillerie. These general terms and conditions of sale apply exclusively between Francine Joaillerie and its subsidiaries and any person visiting or making a purchase through the francinejoaillerie.com website. These products are sold as used items. These terms and conditions apply to the exclusion of all other terms and conditions, including those in effect in physical stores.
Any internet user may review the General Terms and Conditions of Sale on the francinejoaillerie.com website. As these General Terms and Conditions of Sale are subject to change, the applicable terms are those in effect on the website as of the date you place your order. By placing an order, the customer expressly accepts these terms. Francine Joaillerie’s acceptance of the Customer’s order is confirmed by sending an Order Confirmation to the Customer. The Customer must review the order confirmation and immediately notify Francine Joaillerie of any errors or discrepancies. Otherwise, Francine Joaillerie will deliver the product in accordance with the order confirmation, which will be binding on the Customer.
ARTICLE 1 – PRICE
The prices of our products are listed in euros, including all taxes (VAT + other taxes), excluding processing and shipping fees. The prices of our products are retail prices. For orders shipped to countries other than mainland France, any customs duties or local taxes will be the responsibility of the recipient. All orders, regardless of their origin, are payable in euros. Francine Joaillerie reserves the right to change its prices at any time, but products will be billed based on the prices in effect at the time the order is placed. The price to be paid by the Customer is indicated on the Order Confirmation and the invoice. The products remain the property of francinejoaillerie.com until full payment has been received by Francine Joaillerie. Payment must be made prior to delivery of the Products.
Despite our best efforts, it is possible that a small number of the hundreds of items listed on our website may have a pricing error. Rest assured, however, that we verify prices when processing your order. If the corrected price is lower than the price displayed on the site, we will charge you the lower price and ship your item to you. If the corrected price is higher than the price displayed on the website, we will notify you and cancel your order unless you choose to accept the order at the new price.
ARTICLE 2 – ORDER / CONFIRMATION

Contractual information is provided in French and will be confirmed in a document containing this contractual information no later than the time of delivery. francinejoaillerie.com reserves the right to cancel or refuse any order from a customer with whom there is a dispute regarding payment for a previous order.
Any order placed by the Customer is considered firm and final upon receipt by Francine Joaillerie.
For your security, we pay special attention to credit card payments. We systematically verify that the information we have on file matches. Francine Joaillerie reserves the right to request a photocopy of the buyer’s ID and proof of address for all orders. These measures enable us to effectively combat any fraudulent use of your payment methods.
Any subsequent changes to the order for any reason whatsoever—including changes to the merchandise or delivery times—must be made in writing and are permitted only with the express prior consent of Francine Joaillerie.
CONFIRMATION You hereby declare that you have read and accepted these Terms and Conditions of Sale prior to placing your order. Confirmation of your order therefore constitutes acceptance of these General Terms and Conditions of Sale. Unless proven otherwise, the data recorded by francinejoaillerie.com constitutes proof of all transactions between francinejoaillerie.com and its customers.
ARTICLE 3 – TERMS AND CONDITIONS OF THE CONSIGNMENT SALE
The customer submitting items for appraisal warrants that they have full and complete ownership of the items and the authority to sell them. Any estimate provided by phone or email is in no way binding on Francine Joaillerie. The final in-person estimate may differ from the one provided by email or phone, due to an imprecise or incomplete description; in such cases, Francine Joaillerie may offer a purchase price or consignment price different from the one proposed by email or phone. No claims from the consigning customer will be accepted by Francine Joaillerie in this regard.
The consigning customer authorizes Francine Joaillerie (for a minimum period of three months) to sell, in the customer’s name and on the customer’s behalf, the item(s) consigned, using all means at its disposal in-store, via the website, at auctions, or at trade shows and exhibitions in France and internationally.
Francine Joaillerie reserves the right to decide whether or not to list products on its website; the timing of when products are listed is determined according to the schedule set by Francine Joaillerie. Under no circumstances will Francine Joaillerie be held responsible for delays in listing products online. Rest assured that we are doing everything in our power, in our mutual interest, to sell your item as quickly as possible. The amount paid to the consignor for each item consigned is the price indicated on the Consignment Sales form. Payment for consigned items is made after the buyer has paid the full amount for the product in question.
ARTICLE 4 – AVAILABILITY
Our product offerings and prices are valid as long as they are displayed on the website, while supplies last.
Information regarding product availability is provided at the time you place your order. In the event that a product becomes unavailable after you have placed your order, Francine Joaillerie will promptly notify you by any means of a new delivery date as soon as it receives the relevant information. In this case, the Customer may cancel their order and receive a refund for any deposit they may have paid to Francine Joaillerie.
The refund will be issued, at Francine Joaillerie’s discretion, either as a credit to the customer’s bank account or by check, no later than thirty days after the customer has paid the amounts due.
In the event that an item is unavailable, Francine Joaillerie may deliver to the Customer another item of equivalent quality and price to the one originally ordered, subject to the Customer’s express consent.
In the event of a default, Francine Joaillerie reserves the right to cancel all or part of orders that have already been paid for and, in such a case, undertakes to refund the Customer, by any means, any amounts the Customer may have already paid.
ARTICLE 5 – DELIVERY
Products are shipped to the shipping address you provided during the checkout process (excluding Switzerland). Delivery takes 7 business days from the date payment is received. These are typical average delivery times and reflect the processing and shipping times for mainland France.
In the event of a delivery delay, the customer may contact francinejoaillerie.com’s customer service department at 06 07 10 31 64 or by email at francine.j@wanadoo.fr. The Customer has the right to cancel their Order if it has not been delivered within seven business days of the delivery date specified by francinejoaillerie.com, unless the delivery delay is due to a force majeure event as defined by French case law. Within 10 business days of the Customer’s cancellation request, francinejoaillerie.com will submit a refund request to its bank on behalf of the Customer. francinejoaillerie.com cannot be held liable for any consequences resulting from a shipping delay. Any delay in delivery beyond the scheduled date due to a shipping delay shall not give rise to damages, withholding of payment, or cancellation of the order by the buyer. The Customer must indicate on the delivery slip, before signing, any missing, damaged, or non-compliant package or Product.
The order will be processed upon receipt of payment. The time it takes to confirm payment and ship the order varies depending on the payment method selected.
Shipping charges apply as indicated on the website. francinejoaillerie.com reserves the right to change its shipping rates at any time, but shipping charges will be billed based on the rates in effect at the time the order is placed.
ARTICLE 6 – PAYMENT
Payment for your purchases must be made in cash:

or by bank transfer
or in cash: up to €1,000 for mainland France and €15,000 for residents abroad.
The payment must be received by Francine Joaillerie within 8 business days; otherwise, the availability indicated at the time of the order will no longer be guaranteed. Francine Joaillerie will notify the customer of the new delivery time if necessary. If the payment is not received by Francine Joaillerie within 8 days, the order will be automatically canceled.
ARTICLE 7 – REFUNDS / CREDIT NOTES
You have 14 days from the date of receipt of the products to request a refund under the circumstances described in Articles 8 and 9.If you exercise your right of withdrawal, Francine Joaillerie will refund the amounts paid no later than 14 days from the date on which Francine Joaillerie is notified of your decision to withdraw. This refund date may be deferred until the product is returned or until you have provided proof of shipment of the product, whichever occurs first.
The refund will be issued via the same payment method used for the purchase. However, if you agree, Francine Joaillerie may use another payment method at no additional cost to you.
In the case of a reservation with in-store pickup, the 14-day withdrawal period does not apply.
No cash-on-delivery shipments will be accepted, for any reason whatsoever.
In the event of a store credit, it is valid for a maximum of 6 months. After this period, any amounts paid will be retained by Francine Joaillerie.
ARTICLE 8 – SATISFACTION GUARANTEED OR YOUR MONEY BACK
You have 14 days from the date of receipt to return any product that does not meet your expectations*. Returns must be sent to Francine Joaillerie, 17, Quai Gabriel Péri, 83990 – St-Tropez, in their original packaging, complete (including accessories, instructions, etc.) and in perfect condition, along with a copy of the invoice. Items returned incomplete, worn, damaged, or soiled by the customer will not be accepted. The refund will be delayed until the goods are received.
In all cases, the customer is responsible for return shipping costs.

ARTICLE 9 – PRODUCT CONFORMITY
We are committed to exchanging any products that are defective or do not match your order. In such cases, please provide a detailed written description of the issue and return the product(s) to us. Francine Joaillerie will, at your discretion, either exchange the product(s) or issue a credit. The request must be made within fourteen business days of delivery. Any claim made after this period cannot be accepted.
Shipping costs will be refunded based on the invoiced rate, and return shipping costs will be refunded exclusively for residents of France (excluding the French overseas departments and territories).
In any case, you are entitled to the provisions of the legal warranty, particularly those relating to the warranty against hidden defects.
The provisions of this article do not prevent you from exercising your right of withdrawal (satisfaction or refund) as provided for in Article 8.

ARTICLE 14 – WARRANTY
All watches purchased from Francine Joaillerie are covered by a 1-year warranty starting from the date shown on the invoice. During the warranty period, Francine Joaillerie agrees to repair, free of charge, any manufacturing defects existing at the time the watch is delivered, as well as any malfunctions.
However, the watch warranty does not cover:
a problem caused by an accident,
a problem caused by water,
a problem caused by improper handling,
a problem caused by a lack of care or unauthorized third-party interference, as well as any resulting damage.
wear and tear or damage to the battery, strap, case, crystal, pushers, and crown.
ARTICLE 15 – GOVERNING LAW – DISPUTES
This contract is governed by French law.
The language of this contract is French.
In the event of a dispute, the French courts with jurisdiction over the company’s registered office shall have exclusive jurisdiction.
